Terms and conditions
This is a translation for your convenience. The Dutch version is the binding one: read it here.
1. Who and what
Sirob is a service of Marketing Maatwerk (sole proprietorship of B.J.T. Kusters), Dutch Chamber of Commerce (KvK) number 91114551, Enschede. Contact: support@sirobcrm.nl. Sirob is a CRM for businesses that keeps itself up to date on the basis of the customer’s business email, calendar and documents. These terms and conditions apply to every use of the service; deviations apply only if made in writing.
2. Account and use
- The service is intended for business use. The customer is responsible for the users it invites and for keeping login credentials confidential; two-factor authentication is mandatory for admins.
- The customer only connects mailboxes, calendars and documents it is authorised to connect and warrants that it has a legal basis for the processing of the data in them (see also the data processing agreement).
- Misuse (spam, unlawful content, intrusion into systems, resale without agreement) may lead to suspension of the account.
3. AI assistance
- Sirob makes proposals (classifications, profiles, tasks, draft replies) with the help of AI. By default, proposals are only carried out after approval by a user of the customer.
- The customer can turn on automatic execution itself (for example automatic sending above a confidence threshold); whatever is then sent or scheduled counts as an act of the customer.
- AI output may contain errors. The customer remains responsible for the content of messages and appointments that are sent or scheduled on its behalf; Sirob provides the control instruments (review queue, undo button, audit log).
4. Availability and maintenance
- During the pilot phase a best-efforts obligation applies, not a guaranteed availability level. Maintenance takes place outside office hours where possible.
- Encrypted backups are made daily (retained for 14 days). Sirob makes every effort to prevent data loss, but the customer’s mailbox always remains the source: Sirob never deletes email from the customer’s mailbox without an explicit action by a user.
5. Prices and payment
- Use is settled via a balance (advance payment); usage is deducted daily. Prices are always exclusive of VAT. For pilots, different (free) arrangements may apply; these are set out in the pilot agreement.
- At a balance of zero the AI processing pauses; data and access are retained.
6. Term and termination
- The agreement runs month to month and can be terminated monthly, effective at the end of the calendar month, by email to support@sirobcrm.nl.
- After the end, Sirob erases all customer data within 30 days; backups are then automatically rotated out within 14 days. On request, an export in a common format is provided first.
7. Liability
- Sirob is not liable for indirect damage (including lost profits, missed savings and reputational damage).
- The total liability per event or series of related events is limited to the amount the customer paid for the service in the three months before the event, or 500 euros if that is more than the amount paid (as with a free pilot).
- These limitations do not apply in the event of intent or conscious recklessness on the part of Sirob.
8. Privacy
The processing of personal data is set out in the privacy statement (app.sirobcrm.nl/privacy). For the data in the customer’s CRM the parties enter into a data processing agreement; it forms part of the agreement.
9. Changes and applicable law
- Sirob may change these terms and conditions; account holders are informed by email at least 30 days in advance. In the event of an objection the customer can terminate free of charge before the effective date.
- Dutch law applies to the agreement; disputes are submitted to the competent court of the Overijssel district.
